Terms of Service — TAGO
Throughout the site and platform, “we,” “us,” and “our” refer to TAGO. We offer this website, digital platform, and related services (collectively, the “Service”) subject to your acceptance of all terms, conditions, policies, and notices stated here.
By accessing our website, creating an account, or purchasing products/services from us, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
We may update these Terms at any time by posting a revised version on our website. Continued use of the Service after changes means you accept the updated Terms.
Our e-commerce store is operated via Shopify Inc. Our SaaS and digital services are hosted within the European Union.

0. Definitions
“Account” means a user account registered on the Service. “Customer”/“you” means the natural or legal person using the Service. “Hardware” means TAGO physical tags/cards/devices. “Platform” means the TAGO web app and related APIs. “Content” means data, text, logos, images, links, reviews, and other materials you upload or provide.
1. Eligibility
You confirm that you are at least the age of majority in your country of residence, or you have parental/guardian consent if under the age of majority.
2. Scope of Service
TAGO provides:
- NFC/QR tools for collecting customer feedback,
- SaaS dashboards for analytics and review management,
- physical products (tags, cards, devices),
- related digital services.
You may not use the Service for unlawful or unauthorized purposes.
3. General Conditions
We may refuse Service to anyone at any time. You must not reproduce, copy, resell, or exploit any part of the Service without our prior written consent. Do not interfere with the security or integrity of the Platform.
4. Account Responsibilities
You are responsible for safeguarding your credentials and all activities under your Account. Keep registration and billing information accurate and up to date and notify us of any unauthorized use.
5. Subscriptions and Billing
Some services are subscription-based. Subscriptions renew automatically unless cancelled before renewal. You authorize us to charge your chosen payment method for fees and applicable taxes. You may cancel at any time via your dashboard; access continues until the end of the paid term.
Trials: if offered, regular billing starts after the trial unless you cancel. We may change prices with prior notice for future terms.
Refunds: subscription periods already started are non-refundable except where required by law.
6. Products, Orders, and Returns
Physical products are sold subject to availability. We may limit or cancel orders (for example, suspected resale or fraud).
EU consumers’ right of withdrawal. Consumers in the EU can withdraw from distance contracts within 14 calendar days under Latvian law and EU Directive 2011/83/EU. To exercise, notify us in writing within 14 days. Refunds are issued within 14 days of your withdrawal notice; we may withhold until we receive the goods or proof of return.
Returned goods must be in original condition (reasonable handling allowed to establish nature/characteristics).
Exceptions: custom-made or clearly personalized items (e.g., custom-printed tags) once production has started; sealed software/digital content after unsealing/start of download where applicable.

7. Third-Party Tools and Links
We may provide access to third-party services or links. We do not control and are not responsible for their terms, functionality, or content. Your use is at your own risk.
8. User Content and Reviews
By uploading or submitting Content (including business data, logos, texts, links), you grant TAGO a non-exclusive, worldwide, royalty-free licence to host, display, and process such Content to operate and improve the Service. You represent you have all necessary rights and that your Content does not infringe third-party rights or violate platform policies.
We may moderate or remove Content that we reasonably deem unlawful, infringing, deceptive, or non-compliant with these Terms.
9. Intellectual Property
The Service (software, UI, databases, documentation, trademarks) is owned by TAGO or its licensors and protected by IP laws. Except as expressly permitted, no licence is granted. You may not reverse-engineer, decompile, or create derivative works of the Platform except where required by mandatory law.
10. Data Protection and Privacy (GDPR)
Controller. TAGO acts as data controller for Account and Service operations data. For certain processing of end-customer interactions initiated by you, TAGO may act as processor; in that case, the Data Processing Addendum (DPA) forms part of these Terms.
Purposes & legal bases. We process personal data to provide and improve the Service, for billing, security, support, and compliance (GDPR Art. 6(1)(b), (c), (f), and where applicable consent under Art. 6(1)(a)).
Processors & transfers. We use vetted subprocessors. Where data is transferred outside the EEA, we implement appropriate safeguards (e.g., SCCs).
Your rights. Access, rectification, erasure, restriction, objection, portability, and the right to lodge a complaint with the Data State Inspectorate (Datu valsts inspekcija, Latvia).

11. Communications; Email/SMS Marketing (EU)
We send transactional messages necessary to provide the Service. Marketing messages (email/SMS/push) are sent only with your prior consent and include an easy opt-out. You can withdraw consent at any time via the unsubscribe link or Account settings. Carrier charges may apply for SMS.
12. Service Availability, Maintenance, and Errors
We do not guarantee uninterrupted operation. We may perform scheduled or emergency maintenance and will use reasonable efforts to minimise disruption. We may correct errors, update content, or suspend parts of the Service at our discretion.
13. Prohibited Uses
You must not misuse the Service, including:
- uploading malicious code, scraping, or attempting to bypass security,
- violating IP rights or platform policies,
- misrepresenting identity, gating reviews, or manipulating ratings,
- using the Service to mislead or defraud.
14. Disclaimer of Warranties
The Service is provided “as is” and “as available.” We do not warrant it will be error-free, uninterrupted, or fully secure, or that results will meet your expectations.
15. Limitation of Liability
To the extent permitted by Latvian law:
- TAGO is not liable for indirect, incidental, special, punitive, or consequential losses, including lost profits, revenue, or data.
- Our aggregate liability for all claims arising out of or related to the Service in any 12-month period is capped at the amounts you paid to TAGO for the Service giving rise to the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, wilful misconduct or gross negligence, or any other liability that cannot be limited under applicable law.
16. Indemnification
You agree to indemnify and hold harmless TAGO, its employees, and affiliates from claims arising from your breach of these Terms, your Content, or violation of third-party rights or applicable laws.
17. Termination
Either party may terminate at any time. Obligations and liabilities incurred prior to termination survive. Upon termination, your right to access the Service ceases. For subscriptions, access remains until the end of the paid term unless terminated for cause.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Latvia. Disputes are subject to the exclusive jurisdiction of the Latvian courts.
19. Platform Independence
TAGO is independent and not affiliated with any review or social platform. Our products facilitate compliant review flows but do not guarantee approvals or specific outcomes.
20. Custom Artwork & Platform Guidelines
Customers are responsible for ensuring that artwork and messaging on Hardware comply with applicable platform brand and review guidelines. TAGO may flag likely violations as a courtesy, but the customer remains the final approver and assumes responsibility for compliance.
21. Hardware Warranty
We provide a statutory conformity warranty in accordance with EU/Latvian law for consumers.
Optional – Voluntary Lifetime Hardware Warranty: we may offer a voluntary lifetime warranty for TAGO tags/cards covering manufacturing defects and NFC/QR malfunction. Once per 12 months per item we will repair or replace a faulty item. This does not limit statutory rights and excludes loss/theft and intentional damage; shipping for loss/theft replacements is borne by the customer. Full terms are in our Warranty Policy.
22. Performance Guarantee [Optional]
If, after 90 days of continuous compliant use, your average monthly Google reviews (measured against a verified 90-day pre-installation baseline) have not increased by at least 2Ă—, we will refund the subscription fee and the purchase price of eligible tags.
Conditions (non-exhaustive): minimum traffic thresholds; proper deployment of tags; no policy breaches; location open and operational; no review gating or prohibited incentives; provision of dated analytics/screenshots. Claims must be submitted within 120 days from delivery; we assess within 14 days. This guarantee applies without prejudice to mandatory consumer rights.
23. Shipping Insurance [Optional]
If you purchase our shipping insurance and a shipment is marked delivered but not received, we will reship the order once at no cost (subject to verification and any fraud checks).
24. Force Majeure
We are not liable for delay or failure due to causes beyond our reasonable control (e.g., natural disasters, war, labour disputes, internet/hosting outages, acts of authorities).
25. Assignment
You may not assign these Terms without our prior written consent. We may assign to an affiliate or in connection with a merger, acquisition, or asset sale.
26. Changes to the Service or Terms
We may update the Service and these Terms from time to time. Material changes will be notified via the site or email. If you disagree, stop using the Service before changes take effect.
27. Severability; Waiver; Entire Agreement
If any provision is invalid, the remainder remains in force. Failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, Refund & Return Policy, DPA (where applicable), and any order forms, constitute the entire agreement.
28. Language
This document is provided in English. If a Latvian version is provided and there is a discrepancy, the Latvian version prevails.
